What Evernua is

Evernua is a tool for recording your final wishes, designating people you trust, and making the right information available to them at the right time.

It is not a notary, a law firm, an insurer or a funeral director. It provides no legal advice and organises no funerals.

What Evernua is not

The wishes and lists of belongings you record here are a statement of intent addressed to those close to you. They are not a will and have no testamentary force.

If you wish to dispose of your estate with legal effect, you must make a will in one of the forms provided by law, ordinarily with a notary. Evernua is a useful complement to a will. It is not a substitute for one.

Likewise, recording a death on Evernua has no civil-status effect whatsoever. A death must still be declared to the town hall and to the relevant authorities in the ordinary way.

Your account

You must be of legal age and provide accurate information.

You are responsible for keeping your password confidential. Choose one you use nowhere else.

One account is for one person. Sharing an account would defeat the two-person confirmation procedure that protects you.

Trusted people

You alone decide who your trusted people are and what each of them may see or do. You may change or withdraw those permissions at any time.

Designating someone does not oblige them to accept, and someone who accepts may withdraw later.

You undertake to inform the people you designate that you have done so. Evernua sends them an invitation, but a conversation is worth more than an email.

Confirmation of death

The procedure requires two different trusted people: one to report, another to confirm. It is deliberately impossible for one person acting alone to open your plan.

This procedure rests on trust, not on documentary proof. Evernua does not verify a death certificate. Choose your trusted people accordingly.

You can reverse a report or a confirmation at any time simply by signing in, which is in itself proof that you are alive.

Availability

We aim to keep Evernua available continuously but cannot guarantee uninterrupted service. Maintenance, incidents and circumstances beyond our control may cause interruptions.

Evernua is currently in preview and provided free of charge. Features may change. If we ever introduce a paid plan, you will be told well in advance and nothing you have already recorded will be held hostage.

Liability

We undertake to provide the service with due care. We cannot be held liable for the consequences of information you enter incorrectly or fail to keep up to date, nor for the decisions or omissions of the people you designate.

Nothing in these terms excludes liability that cannot lawfully be excluded, in particular in the event of gross negligence or wilful misconduct.

Ending it

You can delete your account at any time from Profile & privacy. The deletion is immediate and irreversible.

We may suspend an account in the event of a serious breach of these terms, in particular any attempt to gain access to another person's plan.

Changes and governing law

We may amend these terms. Any substantive change will be notified by email and, where the change concerns your data, will require your renewed consent.

These terms are governed by French law. In the absence of an amicable settlement, any dispute falls within the jurisdiction of the French courts.
